Standard Terms & Conditions
Payments & Terms (US dollars)

 

Terms:   Cash, Check or Credit Card on completion.

We reserve the right to require deposit or pre-payment.

 

Fleet and terms customer terms are net 15, with late fees at 16 days.

Late fees are at 1.8% compounded daily.

Credit cards may be subject to a service fee.

 

RJB Repair Hourly Rates

• Truck repair:  $140.00 per hour.

• Automotive repair:  $120.00 per hour.

• Overtime rate:  $280.00 per hour.

• Welding/Fabrication:  $180.00 per hour.

• Diagnostic fees:

  • Truck:  Minimum 1 hour.

  • Auto:  Minimum 30 minutes. 

  • NOTE:  Diagnostic fees may be waived if repairs are completed in-house.

 

Hourly Service Overtime before 7am and after 4pm Monday-Friday.

Contract (Fleet) Maintenance is quoted based on customer’s needs.

 

All Service and Repairs are “best effort” with no guarantee of success.

 

RJB Repair stocks spare parts for common and high failure parts.  Parts suppliers are abundant in the area.  RJB Repair will stock specific critical spares for a nominal fee.

 

RJB Truck & Auto Repair (RJB Repair) Terms:

• RJB Repair reserves the right to request Credit References and a Credit Application to extend Credit. 

• Credit terms are subject to RJB Repair’s discretion and can change at anytime with no notice.

• Credit as Net Due or Terms is not extended automatically and are subject to credit approval.

• C.O.D. may be required, depending on your credit references and Dun rating. 

• RJB Repair reserves the right to change a customer from Terms or Net Due to C.O.D. at any time and with no advanced warning or explanation.

• Service may require a deposit to start.

• RJB Repair only offers in-shop repairs and service. 

• We bill Hourly or by Contract. 

• We reserve the right to change rates at any time, without prior notice.

• State Sales taxes apply to all sales.

• Invoices for Customers without Net Terms are due and payable Upon Completion.

• Service authorization forms may have different terms and conditions than stated here.

• Signing service authorization is acceptance of service and terms. 

• No vehicle will be released without full payment or terms arrangements.

• Vehicles/equipment left over 5 days will be charged storage fee of no less than $25 per day.

• Vehicles/equipment left over 30 days may be disposed of.

• Service quotes are valid for 5 days.

• In the event of delinquent payment, legal action will be taken, and the buyer will be liable for all resultant collection and/or legal costs. 

 

 

Purchases

      

Issuance of a Purchase Order, signing of an RJB Repair, repair order/quote or entering into any agreement with RJB Repair, acknowledges & accepts RJB Repair Standard Terms & Conditions unless mutually agreed upon in writing prior to the event.

 

Prices for parts are quoted FOB manufacturer or distributor with sales tax due, unless otherwise stated.  RJB Repair is authorized to collect tax in the States of Missouri.  For all orders with point of delivery outside the State of  Missouri, the customer will be required to pay the sales tax directly to the appropriate government agency and agrees to indemnify RJB Repair against any such liability.

 

Title to goods (hardware & software) will remain with RJB Truck & Auto Repair. until payment for those goods has been received in full.

 

Shipping Policies: RJB Repair standard shipping is via UPS ground.  RJB Repair will ship any reasonable method at actual charges.  Insurance is added to the cost of shipping unless declined by the client in writing.  Partial shipments will be invoiced on shipment of goods and are subject to the same terms as above.

 

Damaged goods are not to be returned without prior authorization from RJB Repair. Upon receipt of your parcel, please check over the contents carefully.  Damages noted should be recorded on the shipping manifest and notification should be made to RJB Truck & Auto Repair. ASAP.

      

Returns will be accepted only at the discretion of RJB Truck & Auto Repair., and then only after issue of a return merchandise authorization (RMA) number. Returns are subject (at RJB Repair discretion) to a 20% restocking charge. Custom built Hardware, and/or custom ordered items are non-returnable and non-cancelable.

  

Ordering

RJB Repair accepts written and verbal hardware orders with confirmation but prefers signed service orders.  If we receive verbal orders, we will respond to the verbal order with an email verifying what is expected and will not proceed without verification.  All orders will be acknowledged.

 

Order Changes

RJB Repair is not required to accept any requested change after order acknowledgement; however, all reasonable requests for changes will be honored and tracked.  All requests for order changes by customers must be confirmed, in writing, by RJB Repair in order to be effective.  Any order change accepted after order acknowledgement is subject to our ability to confirm and will be subject to a charge for materials, labor, and other costs involved in the change depending on the status of the order at the time of the change request.

 

Cancellations

Acknowledged orders, including order changes, may not be canceled without the consent of RJB Repair.    If a cancellation is approved, the order will be subject to cancellation charges consisting of an administrative fee of at least $10 plus labor and any out-of-pocket expenses incurred by RJB Repair.

Warranty Information 

 

RJB Truck & Auto Repair. warrants products to be free from defects in material or manufacturing for the period of the original manufacturer’s warranty. This warranty does not apply to uses not in compliance with specific applications and installation procedures set forth by RJB Repair or the Manufacturer.

 

Labor for Repair is warranted based on the job and will be noted on the service ticket. 

 

RJB Repair does not warrant any software nor provide service agreements on software.  RJB Repair does provide support for software but will learn software packages to support customers’ needs.

 

All warranty obligations of RJB Repair shall be limited, at the discretion of RJB Repair, to repair or replacement of the defective part.  In no event will RJB Repair be responsible for damage caused by user negligence or Acts of God.

 

RJB Truck & Auto Repair warrants all parts sales equal to the original manufacturer’s terms and conditions.  RJB Repair will immediately order/exchange defective merchandise with an identical or like item for a period of equal to the manufacturer’s warranty.  For advanced exchange warranty service over 30 days, RJB Truck & Auto Repair. may require a Credit Card Deposit.  All other RMA’s will be processed based upon Manufacturers turnaround time.

 

These Terms and Conditions are expressly in lieu of all other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, all such other warranties being hereby expressly excluded.

 

Indemnification

 

You agree to indemnify, defend and hold harmless  RJB Truck and Auto Repair, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. RJB Repair reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with RJB Repair in asserting any available defenses.

 

Arbitration

 

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

 

Class Action Waiver

 

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and RJB Truck and Auto Repair agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of representative or class proceeding.

 

Liability Disclaimer

 

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. RJB TRUCK AND AUTO REPAIR AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

 

RJB TRUCK AND AUTO REPAIR AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. RJB TRUCK AND AUTO REPAIR AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RJB TRUCK AND AUTO REPAIR AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF RJB TRUCK AND AUTO REPAIR OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

 

Termination/Access Restriction

 

RJB Repair reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Missouri and you hereby consent to the exclusive jurisdiction and venue of courts in Missouri in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

 

You agree that no joint venture, partnership, employment, or agency relationship exists between you and RJB Repair as a result of this agreement or use of the Site.  RJB Repair‘s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of  RJB Repair‘s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by RJB Repair with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

 

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and RJB Repair with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and RJB Repair with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

 

Changes to Terms

 

RJB Repair reserves the right, in its sole discretion, to change the Terms under which https://rjbrepair.com/ is offered. The most current version of the Terms will supersede all previous versions. RJB Repair encourages you to periodically review the Terms to stay informed of our updates.
